How do you qualify?

You can get qualified in 5 minutes. It is free and over the phone at 781 848 8545 or in person with a bankruptcy lawyer. Our offices are open late-night and on weekends for your convenience.

When can you expect relief?

As soon as your case is filed. Once you file for Chapter 7 or Chapter 13, an injunction known as the “automatic stay” goes into effect, requiring creditors to stop all collection actions, including lawsuits. Banks and mortgage companies must halt foreclosure proceedings. The stay is temporary and may be challenged, but it can help you avoid eviction or the repossession of your cars, appliances, and other assets.

Frequently asked questions

Chapter 7 is an immediate liquidation or discharge of all of a single debtor's or married couple's unsecured debt. A Chapter 13 is a 3 or 5 year process (a “plan”) that ends with a discharge of any unsecured debt over and above what you are able to pay off during that timeframe. Oftentimes in a Chapter 13, creditors end up getting paid only pennies on the dollar.

There are two requirements: (1) you pass the means test (your monthly expenses are higher than your monthly income, typical for those unable to pay bills and considering bankruptcy) and (2) your household income is below the Massachusetts median income for your household size, determined by how many individuals live there on a regular basis.
Current median annual income limits in Massachusetts
1-person household$85,941
2-person household$109,248
3-person household$134,809
4-person household$162,111

Absolutely. Filing bankruptcy triggers an “automatic stay” on any collection efforts (foreclosure, wage garnishment, vehicle or personal property repossession, lawsuits by a creditor), and it goes into place immediately. If you call us on the morning your home is scheduled for a foreclosure auction, we can typically avoid the foreclosure by filing your petition and sending the bank notice of the automatic stay. If a car or property is repossessed, we can typically look back one or two weeks to have it returned upon an immediate filing of a voluntary petition.

Primary residences of individuals considering bankruptcy are nearly always fully exempt from collection via the Massachusetts Homestead Statute. The automatic homestead covers $250,000 in equity. A declared homestead exempts $500,000 in equity, and a disabled/elderly person homestead covers $1,000,000 in equity. If married, spouses can combine their homestead exemptions in many instances, even if only one spouse is considering filing.

For Chapter 7, the court cost is $335. For Chapter 13, the court cost is $310. Our fees range depending on complexity, but generally fall between $2,000 and $4,500.

We serve all of Massachusetts. Since COVID, the court allows trustee meetings to take place over Zoom, so there is no need to travel in person for many bankruptcy matters, from filing through discharge.

Nick is hands down the best in my opinion. Two years ago I had to make a difficult choice on whether bankruptcy was the road I needed to take. When I met with Nick I was in a bad place mentally because of the stress from my finances. Nick helped me go over my options one by one. This helped with the stress a lot and I ultimately decided bankruptcy was the best option. He genuinely cares about his clients and that made the whole process smoother. I highly recommend Nick and this firm to anyone.
